These Terms of Service ("Terms") apply to your access to and use of the websites, digital products, and services (collectively, "Services") provided by Samui Telehealth ("Samui Telehealth" "we" or "us").

The Services are not intended for use in an emergency.

If you are experiencing a medical emergency, call 1669 or 191.

It is your responsibility to seek appropriate emergency care immediately if your condition worsens while waiting for consultation or treatment.

You may use the Services only if you agree to form a binding contract with us.

If you accept these Terms on behalf of another legal entity, you represent that you have full legal authority to bind such entity to these terms.

You may use the Services only in compliance with these Terms and all applicable laws, rules, and regulations.

You must be at least 18 years old to register and use the Services, or you must be the parent or legal guardian of someone under age 18 who is enrolled in the Services.

In using the Services, you agree not to:

• Misrepresent your identity in any way;

• Gain unauthorized access to the Services;

• Allow any other person to use the Services with your registration.

You understand that through your use of the Services you consent to our Privacy Policy.

Please read these Terms carefully and make an informed decision before using any of the Services.

Benefits of telehealth include but are not limited to, convenience, efficiency, improved healthcare access, and prevention of hospital-acquired infections.

Limitations of telehealth include but are not limited to, limitations with performing comprehensive physical examinations, technical difficulties, and data security breaches.

The Consulting Doctor ("Consulting Doctor") reserves the right to make a professional judgment about the suitability of your condition for the Telehealth Consultation ("Telehealth Consultation" or "Consultation").

The waiting time for your Consultation is not certain and can be delayed for an uncertain time due to the availability of the Consulting Doctor.

Our Telehealth Consultations are not for medical certificate requests.

You agree not to record your Consultation in any form, including, but not limited to, recording audio or video, except with our prior written consent.

The decision to prescribe any medications rests entirely with the Consulting Doctor.

We do not offer online prescriptions.

Controlled substances will not be prescribed under any circumstances.

Medication deliveries are made between 8 am and 8 pm.

The stated delivery time is always approximate and is non-binding in any case.

We reserve the right to not deliver medication to certain addresses at our discretion.

We do not accept insurance.

We may offer payment through a third-party payment provider.

You acknowledge and agree that we have no control over the actions of the third-party payment provider, and all payment information is collected and stored through the third-party payment provider.

We reserve the right to cancel your Consultation for any reason, including, but not limited to, unavailability of the Consulting Doctor. If we cancel your Consultation due to a lack of available Consulting Doctors, we will provide you with a full refund of the Consultation fee.

We reserve the right to cancel your Consultation in progress if your behavior towards the Consulting Doctor becomes abusive or inappropriate, or if we encounter technical issues. If the cancellation is caused by your inappropriate behavior, you will not be entitled to a refund. If the cancellation arises from our technical difficulties, we will issue a full refund of the Consultation fee.

You must provide accurate and complete registration information.

It is your responsibility to provide us with a true, accurate, and complete e-mail address, physical address, and other information, and to maintain and update promptly any changes in this information.

You acknowledge and consent to receive communications by email, text message, telephone calls, and other reasonable means.

You agree that in providing the Services, we may use and disclose your information for treatment, payment, and healthcare operational purposes.

If you provide suggestions, ideas, or feedback ("Feedback") to us, we are free to use, disclose, reproduce, license, or distribute the Feedback, without an obligation or restriction to you.

You are responsible for maintaining the confidentiality of your private URLs generated for you when you use the Services, and you are fully responsible for all activities that occur through your private URLs.

You are responsible for obtaining, installing, maintaining, and operating all software, hardware, and other equipment (collectively, "Equipment") necessary for you to access and use the Services.

You are responsible for obtaining internet services.

You acknowledge that there are certain security, transmission error, and access availability risks associated with using the internet, and you hereby expressly assume such risks.

You are responsible for the data security of the Equipment used to access the Services.

We are not responsible for any errors or problems that arise from the malfunction or failure of the internet or your Equipment.

We reserve the right to suspend or terminate your use of the Services for any reason, including, but not limited to, a belief that your conduct or your use of the Services violates applicable laws or is harmful to the interests of Samui Telehealth or any other users.

We also may place limits on, modify, suspend, or terminate the Services generally.

These Terms are personal to you and are not assignable, transferable, or sublicensable by you except with our prior written consent.

Samui Telehealth may assign, transfer, or delegate any of its rights and obligations hereunder without your consent.

We may revise these Terms from time to time.

Any changes to the Terms will be effective immediately upon posting of the revised Terms.

It is your responsibility to continuously monitor these Terms for any changes or updates.

By continuing to access or use the Services on or after the Effective Date of the revised Terms, you agree to be bound by the revised Terms.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. YOUR USE OF THE SERVICES ARE AT YOUR OWN RISK. ACCESS TO THE SERVICES MAY BE INTERRUPTED AND INFORMATION, SERVICES, AND MATERIALS MAY NOT BE ERROR-FREE.

NONE OF SAMUI TELEHEALTH, ITS AFFILIATES, OR ANYONE ELSE INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE SERVICES AND MATERIALS CONTAINED THEREIN ASSUMES ANY LIABILITY OR RESPONSIBILITY FOR THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION, SERVICES, AND MATERIALS PROVIDED ON THE SERVICES; THEY ALSO SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF, OR YOUR INABILITY TO USE THE SERVICES FOR ANY REASON. YOU ACKNOWLEDGE AND AGREE THAT THE LIMITATIONS SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THESE TERMS AND THE SERVICES WOULD NOT BE PROVIDED TO YOU ABSENT SUCH LIMITATIONS.
